Proposal Terms & Conditions
Please review the terms & conditions of the proposal below. Do not hesitate to reach out with any questions. We sincerely appreciate the opportunity to work with your team and look forward to beginning this Project. Unless otherwise noted directly within your proposal, the following terms and conditions fully apply:
APT is authorized to commence and complete the usual and customary work on the Work Site as may be required in the judgment of APT to complete the Project. Unless called for in the plans or specifications, no landscaping, finish grading, filling, or excavation is to be performed at the Work Site by the Contractor.
APT shall have no responsibility for the condition of the soils at the Work Site. Any excavation, filling or other work required by the client other than the usual and customary excavation and grading shall be agreed to in a Change Order for an amount in addition to the Contract Price. APT shall not be responsible for any damages suffered by the client due to the soil conditions at the Work Site.
EXISTING PIPE CONDITIONS
Due to the delicate condition of the existing pipe(s), the possibility of the pipe collapsing exists during the cleaning/rehabilitation phase. An additional estimate will be provided for a necessary point repair to complete the lining process if this unlikely event occurs. Due to the poor condition of the original host pipe, minor settling may appear at the surface grade post lining. This condition is not covered under warranty.
APT is not responsible for cost of water usage. The client will supply access to a water source for all pipe cleaning and rehab activities.
TIME OF COMPLETION
APT shall commence the work to be performed under this Contract after we have received official notice to proceed. APT shall not be liable for any delay due to circumstances beyond its control, including strikes, casualty, acts of God, illness, injury, or general unavailability of materials. Unforeseen conditions can affect the amount of time to complete the work; any estimation given on the completion time frame is based on known conditions only.
CHANGES TO SCOPE OF WORK
The client may make changes to the scope of the work during the Project. However, any such change or modification shall only be made by written "Change Order" signed by both parties. Such Change Orders shall become part of this Contract. The client agrees to pay any increase in the project's cost as a result of a Change Order.
APT warranty shall be limited to defects in workmanship within the scope of work performed by APT and which arise and become known within one year (1) year from the date hereof. All said defects arising after one (1) year and defects in the material are not warranted by APT. APT hereby assigns to the client all warranties on materials as provided by the manufacturer of such materials.
PRICE & PAYMENT
The client agrees to pay APT for performing the services outlined in the scope of the work. APT shall be paid as follows: Net 30 terms begin from the date of work completion.
